Empery Faces Limited Restrictions In ATG Proxy Fight
Monday, October 26, 2026 · first reported by Law360
The Delaware Chancery Court ruled on Monday that Empery Digital Inc. has to give ATG Capital Opportunities Fund LP five business days' notice before it takes certain major corporate actions. The requirement lasts while the two sides contest a board seat. The court turned down wider restrictions on the company, which could have given activist investor ATG outsized influence over Empery's operations.
