SEC Proposes Broad Custody Changes for Advisers & Registered Funds, Including New Crypto Custody Pathways

Thursday, October 22, 2026 · first reported by Morgan Lewis via JD Supra

A proposal released by the US Securities and Exchange Commission on October 1, 2026 would change how registered investment advisers, registered funds and business development companies (BDCs) meet custody obligations. Under the Custody Proposal, advisers could self-custody crypto assets through a new pathway, and state trust companies would get a separate pathway to serve as crypto custodians. The proposal also modernizes some of the custody provisions in the Investment Advisers Act of 1940.
