Regulation Update: The SEC’s new digital asset framework, and what RIAs should be thinking about
Thursday, October 29, 2026 · first reported by IREI
The SEC has issued an interpretive release on how federal securities laws apply to certain digital assets and related transactions. It does not settle every open question, but it sets out a more structured way to analyze digital assets under existing securities law. The release separates different types of digital assets instead of treating them as one group. An article by Joel Hergenreter in Real Assets Adviser looks at what it means for registered investment advisers: classification, diligence, disclosures, communications and risk when clients or portfolios have digital asset exposure.
